1. Services Overview

We provide professional pest control treatments, radon mitigation systems (including active soil depressurization and related components), and vapor barrier installations for residential and/or commercial properties. Services are performed in accordance with industry standards, applicable laws (including those in Washington and Idaho where relevant), and manufacturer guidelines.All Services are subject to an initial inspection or assessment. We reserve the right to determine the appropriate methods, products, and scope based on site conditions.

2. Pricing, Payment, and Forever Price Lock (Pest Control Plans)

• Pricing for Services is quoted at the time of proposal or agreement and is valid for acceptance within 30 days unless otherwise stated.

• Payment terms are as specified in your service agreement or invoice (e.g., deposit required upfront, balance due upon completion or per schedule).

• For qualifying pest control plans, we offer a Forever Price Lock guarantee, under which your regular service fee will not increase for the duration of your active plan.

• This Forever Price Lock is valid only for as long as: (a) your pest control plan remains continuously active and in good standing (with timely payments and no uncured breaches), or (b) the Company remains in operation and continues to offer the plan, whichever occurs first.

• The price lock does not apply to additional services, one-time treatments, emergency calls, excluded pests, changes in service scope requested by you, taxes, regulatory fees, or increases mandated by law. We may adjust pricing for new or separate services.

• We reserve the right to terminate or modify any plan (including the price lock) with notice if you breach these Terms, fail to maintain the property as required, or if unforeseen circumstances affect service delivery.

3. Customer Responsibilities

To ensure effective Services, you agree to:

• Provide safe, unobstructed access to all relevant areas of the property.

• Follow our preparation instructions (e.g., clearing areas, removing items, pet/animal safety).

• Maintain the property free of conditions conducive to pests, radon entry, or moisture issues (e.g., proper sanitation, sealing leaks, avoiding self-treatment with conflicting products).

• Notify us in advance of any known sensitivities to products or materials.

• For pest control: Cooperate fully during treatments and report issues promptly.

• For radon mitigation and vapor barriers: Allow necessary modifications (e.g., drilling, sealing, piping) and maintain the installed system (e.g., not tampering with fans, piping, or barriers; ensuring normal operation without unauthorized alterations).

Failure to cooperate may void guarantees, warranties, or price locks, and we may suspend or terminate Services without refund.

4. Warranties and Guarantees

• Pest control plans include re-treatment at no extra charge for covered pests if activity recurs during the active plan term, subject to your cooperation and our inspection.

• Radon mitigation systems carry a 5-year warranty from the date of installation, under normal operation and proper maintenance by the customer. We warrant that the system will reduce radon levels below the EPA guideline of 4.0 pCi/L (or as otherwise specified), subject to post-installation testing and no material changes to the property.

• Vapor barrier installations carry a 10-year warranty from the date of installation, under normal operation and proper maintenance by the customer, against defects in materials and workmanship that cause failure to control moisture as intended.

• Warranties apply only during the specified period while you remain the property owner and the system remains unaltered/unmodified except by us or with our approval. We do not guarantee elimination of all moisture, mold, pests, or radon-related health risks, as results depend on property conditions, usage, maintenance, and factors beyond our control.

• No lifetime or perpetual guarantees are provided unless explicitly stated in your written agreement. Any warranties are in lieu of all other warranties, express or implied.

5. Cancellation

Pest control plans and other ongoing Services are provided without long-term contracts. Either party may cancel at any time without notice or penalty, subject to payment for Services already rendered (e.g., prorated charges or repayment of any discounted initial fees if applicable). We may suspend or terminate Services immediately for non-payment, breach, safety concerns, or inability to perform.

6. Limitation of Liability and Disclaimers

To the fullest extent permitted by law (including under Washington and Idaho law):

• Services and any installed systems are provided "as is" without warranties of any kind, express or implied, beyond those explicitly stated above, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

• We are not liable for indirect, consequential, incidental, special, punitive, or exemplary damages, including (without limitation) property damage, personal injury, lost profits, health effects related to pests, radon exposure, moisture issues, or mold, or any other losses arising from or related to the Services.

• Our total liability for any claim arising from or related to the Services shall not exceed the amount paid by you to us for the specific Service giving rise to the claim.

• We are not responsible or liable for pre-existing conditions, third-party actions, acts of God, your failure to follow recommendations/maintain the property, unauthorized modifications, changes in environmental conditions, or other factors beyond our reasonable control.

• Nothing in these Terms limits liability for our gross negligence, willful misconduct, or fraud, where such limitations are prohibited by applicable law in Washington or Idaho.

• We disclaim all liability for health risks associated with radon, pests, or moisture, as we are not medical professionals and cannot eliminate all risks.

7. Changes to Terms

We may update these Terms at any time. Changes will be posted on the Site, and continued use constitutes acceptance.

8. Governing Law

These Terms are governed by the laws of the State of Washington and/or Idaho (as applicable to the location of the Services or your property), without regard to conflict of laws principles. Any disputes shall be resolved in the courts of the state where the Services were performed.
